Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and nana studios LLC ("we", "us"), the operator of Orbit Core (the "App") and orbitcore.app. By creating an account or using Orbit Core you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility & User Accounts
- You must be at least 16 years old (or the minimum digital-consent age in your country) to use Orbit Core.
- You are responsible for the accuracy of your profile and for all activity under your account. Keep your credentials secure.
- One account per person. Impersonating another person or misrepresenting your identity or work is prohibited.
- Early-adopter statuses (Founding Member #1–100, Pioneer up to #1,000) are assigned automatically by signup order, are personal to your account, are not transferable, and may be revoked for Terms violations.
2. Community Guidelines
Orbit Core is a professional community for creatives. You agree to:
- Be respectful — no harassment, hate speech, threats, stalking or discrimination.
- Post honest collaboration listings and reviews; clearly state whether work is paid or TFP.
- Respect other members' boundaries in messages; unsolicited sexual content is strictly prohibited.
- Only submit real, accurately-described photo spots and respect local laws, private property and permits when shooting.
3. User-Generated Content
You retain all rights to the content you upload (photos, videos, wallpapers, text). By posting, you grant nana studios LLC a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the App and on shareable links you create, solely to operate and promote the service. You can end this license for a piece of content by deleting it, or entirely by deleting your account.
You are responsible for your content. Only upload work you created or have permission to share, including permission from recognizable people in your images where required.
4. Copyright & DMCA
We respect intellectual property and respond to notices under the Digital Millennium Copyright Act. To report infringement, email support@orbitcore.app with: (a) the copyrighted work, (b) the infringing material's location in the App, (c) your contact details, (d) a good-faith statement, and (e) your physical or electronic signature. We remove infringing material and terminate repeat infringers.
5. Prohibited Content & Conduct
- Nudity or sexually explicit content; content sexualizing minors (zero tolerance — reported to authorities).
- Violence, self-harm promotion, or illegal activity.
- Spam, scams, pyramid schemes, fake listings, or deceptive "collaborations".
- Scraping, reverse engineering, automated account creation, or interfering with the App's operation.
- Selling, renting or transferring accounts, badges or usernames.
6. Subscriptions, Billing & Auto-Renewal
- Premium Monthly and Premium Yearly are auto-renewing subscriptions purchased through the Apple App Store or Google Play (or Stripe on the web).
- Payment is charged to your store account at confirmation of purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
- Manage or cancel anytime in your App Store / Google Play subscription settings. Canceling keeps Premium until the end of the paid period.
- Prices may change; we will notify you in advance and changes apply from your next renewal.
- Founding Members receive lifetime Premium as a courtesy benefit; it is not a purchased subscription and has no cash value.
7. Spotlight Purchases
Spotlight is a one-time, non-renewing in-app purchase that features your profile for 5 days. Spotlight activates immediately upon purchase and is therefore consumed at activation. Free periodic Spotlights included with early-adopter tiers have no cash value.
8. Refund Policy
Purchases made through the App Store or Google Play are processed by Apple or Google, and refunds are governed by their policies — request one at reportaproblem.apple.com or through Google Play support. For web (Stripe) purchases, contact us within 14 days at support@orbitcore.app. Except where required by law, consumed Spotlights and partially used subscription periods are not refundable by us.
9. Collaborations Between Members
Orbit Core is a discovery and communication platform. We are not a party to any agreement, shoot, payment or exchange between members, and we do not vet members beyond optional verification badges. Use professional judgment: meet safely, agree on terms in writing, and verify portfolios.
10. Account Suspension & Termination
You may stop using Orbit or delete your account at any time (Profile → Delete Account). We may suspend or terminate accounts that violate these Terms, harm other members, or create legal risk — with or without notice depending on severity. Upon termination your license to use the App ends; sections 3–13 survive.
11. Disclaimers
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation, or that content posted by members is accurate or lawful.
12. Limitation of Liability
To the maximum extent permitted by law, nana studios LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data or goodwill, arising from your use of the App — including interactions or agreements between members. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD $50.
13. Indemnification
You agree to indemnify and hold nana studios LLC harmless from claims arising out of your content, your use of the App, or your violation of these Terms or applicable law.
14. Governing Law & Changes
These Terms are governed by the laws of the United States and the state in which nana studios LLC is registered, without regard to conflict-of-law rules. We may update these Terms; material changes will be announced in the App and take effect upon posting. Continued use constitutes acceptance.
